Following a summer break, our Focus On series starts up again, this time focusing on the topic of “Investment Structuring”. A crucial and timely topic as we look to the financing and growth of economies post-Covid. Our panel discussions aimed to demystify the various reasons why investors would choose a specific jurisdiction.

In his keynote, Luxembourg’s Minister of Finance delved into the topic of international tax reforms at an OECD level and how these will hopefully move the conversation away from the basic level of tax. Rather, it will allow the true fundamentals of financial centres, such as their expertise, toolbox, and the ecosystem to come more to the fore.

Our first panel discussion, “Legal issues at the heart of international investment structuring”, explored the legal framework and the toolbox available to investors. Panellists emphasised that the robustness and breadth of the legal framework is critical for investors when choosing a location. They further highlighted that the variety of securitisation vehicles to suit investments remains an important deciding factor as well.

Our final panel touched on the topic of tax advice. With the aim of answering the question of whether it is “sunset or a new dawn for tax advice?”, our panellists discussed the increasing complexity and rapid pace of change in the overall tax environment. Given the intricacy relating the implementation of new tax directives and the structuring of investments from a tax perspective, the panel resoundingly concluded it was indeed a new dawn.
